How To: Comply with New York City’s Local Law 92/94

As part of the Climate Mobilization Act, New York passes Local Laws 92 and 94 in late 2019. These laws require “Sustainable Roof Zones” on most new construction & permitted roof renovations. The Sustainable Roof Zones require solar arrays (LL 92) or vegetated roofs (LL 94) be installed through the designated space(s).

Any projects receiving permit approval from the NYC Department of Buildings (DOB) are required to comply with these laws. Exceptions are made when some/all of the roof spaces are used for the following:

  • Stormwater detention (i.e. blue roofs)
  • Access or setbacks needed to satisfy other building code or zoning requirements
  • Mechanical equipment and essential rooftop structures
  • Occupiable terrace/amenity spaces
  • Recreational spaces critical to the function of the facility (i.e. school play surfaces)
  • Roofs with pitch greater than 2:12 (unsuitable for vegetated roofs)
  • Any other spaces DOB determines infeasibility

In concert with NYC DEP stormwater runoff reduction requirements, LL94 drives many owners to maximize green roof area as a key – and sometimes as the only – means for compliance. A well-planned design, quality green roof system and workmanship are all important to ensure that the investment is worthwhile long-term.

Executing and maintaining a successful green roof in NYC can certainly add some complexity for owners within the city but they are becoming a required norm.
